Terms of Service

Last Updated: June 1, 2025

Please read these Terms of Service carefully before using the FUSE-ID platform. By creating an account or using any FUSE-ID feature, you agree to be bound by these terms.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Athlete," or "Parent/Guardian") and FUSE-ID ("we," "us," or "our") governing your access to and use of the FUSE-ID college athletic recruiting platform, including all features, tools, and services offered through fuse-id.online and any associated applications (collectively, the "Platform").

If you are under 18 years of age, you must have your parent or guardian review and agree to these Terms on your behalf. If you are a parent or guardian creating or managing an account for a minor, you accept these Terms on your own behalf and on behalf of the minor.

We reserve the right to update these Terms at any time. Continued use of the Platform after notice of changes constitutes acceptance of the revised Terms.

2. Eligibility

To use FUSE-ID, you must:

  • Be at least 13 years of age, or have verifiable parental consent if under 13
  • Provide accurate, current, and complete information during registration and onboarding
  • Be a student athlete, parent, or guardian with a legitimate interest in college athletic recruiting
  • Not be prohibited from receiving services under applicable laws

We reserve the right to verify eligibility and to terminate accounts that do not meet these requirements.

3. Account Registration & Security

3.1 Account Creation

You may register for a free account using a valid email address and password. No credit card is required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

3.2 Accurate Information

You agree to provide truthful, accurate, and current information about yourself, including your athletic profile, academic record, club affiliations, and recruiting preferences. The quality and accuracy of FUSE-ID's AI recommendations depend entirely on the accuracy of the data you enter. We are not liable for match engine outputs or recommendations based on inaccurate or incomplete profile data.

3.3 Account Security

You agree to notify us immediately of any unauthorized access to or use of your account. We are not responsible for losses arising from unauthorized account access resulting from your failure to maintain credential security.

4. Platform Features & AI Tools

4.1 AI Match Engine

The AI Match Engine generates a scored, ranked list of college athletic programs based on your profile data. This output is provided for informational purposes only and does not constitute a guarantee of athletic interest, admission, or scholarship. Match scores are estimates based on publicly available program data and your self-reported profile.

4.2 AI Email Drafting

The AI Email Draft tool generates suggested outreach content for your review and use. FUSE-ID does not send emails on your behalf. You are solely responsible for reviewing, editing, and sending any communications to college coaches. You represent that any email you send using AI-drafted content is truthful and accurately represents you.

4.3 Merit Aid & Financial Estimates

Merit aid estimates, net cost calculations, and scholarship range projections are estimates only. They are based on historical institutional data and your academic profile, and do not represent commitments or guarantees from any college or university. Actual financial aid awards are determined exclusively by each institution.

4.4 Recruiting Data Accuracy

Program information, roster data, and academic profiles in the FUSE-ID database are updated on a seasonal cycle and sourced from publicly available information. We make reasonable efforts to maintain accuracy but cannot guarantee that all program data is current or error-free. Users should verify material information directly with institutions.

5. Token System & Paid Features

5.1 Free Tier

Free accounts include one (1) match engine run at registration and limited email draft access. All pipeline management, communications logging, and offers tracking features are available at no cost.

5.2 Token Packs & Subscriptions

Additional AI feature access is available through one-time token pack purchases or monthly/annual subscription plans. All pricing is displayed in U.S. dollars. Payments are processed through our third-party payment processor (Stripe). By purchasing a token pack or subscription, you authorize the applicable charge.

5.3 Token Expiration

Purchased tokens do not expire. Subscription tokens allocated monthly do not roll over to the following month. Tokens are non-transferable and non-refundable except as required by applicable law or as described in our refund policy.

5.4 Pro Tier Fair Use

The Pro subscription is marketed as unlimited. A soft cap of 100 AI tokens per month applies to prevent abuse. This cap covers all legitimate recruiting activity for the vast majority of users. Accounts demonstrating unusual usage patterns may be reviewed. We will contact affected users before taking any action.

5.5 Refund Policy

Token packs are non-refundable after use. Subscription fees paid in advance are non-refundable unless required by law. If you believe you were charged in error, contact us at bryan.fossi@promotedsoccerconsultants.com within 30 days of the charge.

6. Parent & Guardian Access

Athletes may invite up to two (2) parent or guardian email addresses to access a read-only view of their recruiting board. Parent access is strictly view-only — parents and guardians cannot edit, delete, or add any content through the parent access link. Parent access tokens are time-limited and may be revoked by the athlete at any time. By accepting a parent access invitation, the parent or guardian agrees to these Terms and acknowledges their access is read-only and subject to revocation.

Parents who sign up directly and invite their athlete to share an account have full co-editor access to the shared profile. Shared-account access is bidirectional: either co-owner may edit profile data, draft emails, and manage school pipeline status. Subscription fees and token purchases made by either co-owner cover both accounts.

7. NCAA & Recruiting Rule Compliance

Users are solely responsible for ensuring their recruiting activities comply with applicable NCAA, NAIA, NJCAA, and other governing body rules and regulations. FUSE-ID is a data and communication tool — it does not manage, verify, or guarantee compliance with recruiting rules. Specifically:

  • FUSE-ID does not send emails on behalf of athletes. Athletes send all communications from their personal email accounts.
  • FUSE-ID does not facilitate direct contact between athletes and college coaches through the platform.
  • Athletes and their families are responsible for understanding dead periods, contact periods, and communication rules applicable to their division and sport of interest.

We recommend consulting with your club coach, high school counselor, or a knowledgeable adult before initiating contact with college programs.

8. Acceptable Use

You agree not to use FUSE-ID to:

  • Provide false or misleading information about your athletic or academic profile
  • Impersonate any person or entity
  • Harvest or collect information about other users
  • Interfere with or disrupt the Platform or its infrastructure
  • Reverse engineer, decompile, or extract any part of the Platform or its AI systems
  • Use the Platform for any commercial purpose without written authorization
  • Upload or transmit malicious code, spam, or harmful content
  • Attempt to circumvent the token system or access paid features without payment

We reserve the right to suspend or terminate accounts that violate these standards without prior notice.

9. Intellectual Property

All content, technology, software, and design elements comprising the FUSE-ID Platform — including the match engine, scoring models, prompt templates, user interface, and brand assets — are the exclusive property of FUSE-ID and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform for your personal recruiting activities.

Your athlete profile data, communications logs, and recruiting activity remain yours. You grant FUSE-ID a limited license to use your profile data to operate the Platform and improve its AI features, as described in our Privacy Policy.

10. Disclaimers

THE FUSE-ID PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Platform will be uninterrupted, error-free, or free of harmful components
  • Match scores, merit aid estimates, or program data will be accurate or complete
  • Use of the Platform will result in athletic offers, scholarships, or admission
  • AI-generated email content will be effective or appropriate for your specific situation

YOUR USE OF THE PLATFORM AND RELIANCE ON ANY AI-GENERATED OUTPUT IS AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUSE-ID AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM, INCLUDING LOST SCHOLARSHIP OPPORTUNITIES, RECRUITING OUTCOMES, OR RELIANCE ON AI-GENERATED RECOMMENDATIONS.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO FUSE-ID IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless FUSE-ID and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) any communications you send to college coaches using AI-drafted content; or (d) your violation of any applicable law or third-party right.

13. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, suspected fraud, or for any reason at our discretion with reasonable notice. You may delete your account at any time through your account settings. Upon termination, your access to the Platform ceases, but these Terms survive termination to the extent necessary to enforce our rights.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations.

You waive any right to participate in a class action lawsuit or class-wide arbitration against FUSE-ID.
